STPS amends the provisions for the registration of individuals or legal entities that provide specialized services or perform specialized works (REPSE)

On February 3, 2023, was published in the Official Gazette of the Federation, the Agreement that modifies the one by which the General Provisions for the registration of individuals or legal entities that provide specialized services or perform specialized works referred to in Article 15 of the Federal Labor Law (REPSE), issued by the Ministry of Labor and Social Security (STPS).

Said provisions regulate the registration process, refusal, cancellation, and renewal of the REPSE, and now also the modification and updating of the same.

The key modifications are as follows:

Será necesario adjuntar en la solicitud de registro, el último comprobante de nómina y el último comprobante del Sistema Único de Determinación (SUA) emitido por el Instituto Mexicano del Seguro Social (IMSS) en archivo PDF.
La STPS a través de la Unidad de Trabajo Digno podrá solicitar en cualquier momento información o documentación adicional a las empresas beneficiaras de los servicios u obras especializadas para corroborar y validar la información.
Se otorgan facultades específicas a la Inspección del Trabajo para revisar el cumplimiento de las reglas en materia de subcontratación en las empresas registradas y en las empresas beneficiarias de los servicios u obras especializadas.
Se detallan las violaciones que ameritan la cancelación del REPSE, tales como no tener inscritos a los trabajadores ante el IMSS e irregularidades en el pago del salario o en el contenido de los contratos de prestación de servicios especializados.
