New Organic Statute of the Mexican Petroleum Institute

On February 20, 2023, the Mexican Petroleum Institute ("IMP") published, in the Official Gazette of the Federation ("DOF"), the new Organic Statute ("New Organic Statute"), whereby it establishes a new organizational structure and attributions for each area that conforms it.

The New Organic Statute leaves without effect the previous Organic Statute published by IMP in the DOF on October 31, 2014.

Legal Nature of IMP

IMP was created as a decentralized agency by a Decree published in the DOF on August 26, 1965. The New Organic Statute endorses IMP as a decentralized public agency of the Federal Public Administration, with legal capacity and its assets, as well as technical, operational, and administrative decision-making autonomy, sectorized to the Ministry of Energy.

IMP's Objective

The New Organic Statute states that IMP is a recognized public research center in the energy and hydrocarbons sector whose purpose is to carry out research, technologic development, innovation, scaling up of processes and products, render technologic services to optimize hydrocarbons processes (in exploration and extraction, industrial transformation, transportation, storage and distribution), commercialization of its results in the energy sector, as well as to carry out specialized training.

IMP's activities

The New Organic Statute establishes the functions of IMP as follows: 

  1. Prestación de servicios para el uso eficiente de energía, combustibles limpios y la sustentabilidad de la industria petrolera.
  2. Realizar la certificación de procesos y productos.
  3. Realizar auditorías, supervisión, evaluaciones, inspecciones, verificaciones e investigaciones técnicas en materia de seguridad industrial y operativa y de protección al medio ambiente en el sector hidrocarburos. 
  4. Participar en la elaboración de Normas Oficiales Mexicanas y Normas Emergentes.
  5. Realizar actividades para la protección y comercialización de la propiedad intelectual, inteligencia tecnológica, procesos de gestión, transferencia de tecnología y administración del conocimiento. 
  6. Realizar actividades para la evaluación de la conformidad, tales como calibración, prueba, auditoría, inspección, certificación y verificación.
  7. Elaborar estándares e instrumentos para la evaluación de competencias, así como la realización de las respectivas certificaciones; entre otras.

Administration and Organic Structure

The New Organic Statute states that IMP is managed and administered by a Governing Body composed of a Board of Directors and a General Director, who acts as its legal representative. 

The Board of Directors is integrated by 10 (ten) board members, including the Secretary of Energy, two (2) independent board members, and one representative for each of the following entities: Ministry of Finance and Public Credit, Ministry of Environment and Natural Resources, Petróleos Mexicanos, Universidad Nacional Autónoma de México, Instituto Politécnico Nacional, Universidad Autónoma Metropolitana, and Consejo Nacional de Ciencia y Tecnología. 

Likewise, the New Organic Statute adds a structure for the performance of its attributions, the same that was not found in the previous Organic Statute (published in the DOF on October 31, 2014). The structure of IMP will be as follows:

  1. General Directorate
    • Unidad de Asuntos Jurídicos
  2. Research Directorate
  3. Technology Directorate
  4. Technology Commercialization Directorate
  5. Exploration and Production Division
  6. Engineering and Services Division
  7. Training and Development Division
  8. Institutional Operations Division
  9. Finance and Administration Division
  10. IMP's Internal Control Body

Finally, the new Organic Statute will become effective once it is published in IMP's Internal Regulations, leaving behind the previous Organic Statute published by IMP.
